Pricing, Specifications and Availability

All prices, specifications, features, contents and availability of 4xem products are subject to change at any time without notice. The dynamic nature of the information technology market sector as well as the varying technical differences in our customers’ equipment means that product information may not reflect the most current applicable technical information. We also cannot be responsible for differences in product size, shape or color exhibited in photographs.

Orders placed through 4xem.com will generate an automated confirmation e-mail which confirms the receipt of your order. This confirmation e-mail does not, however, constitute a legal offer to sell. 4xem reserves the right to change pricing, product descriptions or specifications after any confirmation e-mail but before shipment. This is due to errors, changing market conditions, discontinuation of product, unavailability, typographical misinterpretations or other reasons. 4xem also reserves the right to limit the quantity of any item sold or refuse a sale outright.

Payment and Shipping Information

Shipping. All orders shipping to locations within the United States of America will be shipped via UPS (United Parcel Service) or USPS (United States Postal Service). 4xem cannot hold responsibility for any lost or otherwise damaged packages. However, UPS freight charges include prepaid delivery insurance up to limits specified by UPS terms and conditions. If a shipment was sent via UPS and was lost or damaged before arrival, UPS may be contacted directly for insurance claims. For the protection of you and your package, all shipments require a signature at delivery point.

Product Warranty and Limitations

Warranty. 4XEM PROVIDES WARRANTY THAT OUR PRODUCTS WILL BE FREE OF DEFECTS IN MATERIALS AND/OR WORKMANSHIP. NO FURTHER WARRANTY, EXPRESSED OR IMPLIED WILL APPLY. THIS INCLUDES IMPLIED WARRANTIES OF FITNESS FOR A CERTAIN PURPOSE EXCEEDING THE FOREMENTIONED WARRANTY.

Limitation Of Liability. UNDER NO CIRCUMSTANCES SHALL 4XEM CORPORATION, ITS SUBSIDIARIES OR AFFILIATES OR THEIR RESPECTIVE PARTNERS, DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES OR REPRESENTATIVES BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, USE OF PROFITS), HOWEVER CAUSED, WHETHER BY BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, WHETHER OR NOT 4XEM CORPORATION HAS BEEN ADVISED OF THE CONFIRMATION OR POSSIBILITY OF ANY SUCH DAMAGES OR EVENTS. YOU AGREE THAT 4XEM’S MAXIMUM LIABILITY COMING FROM ANY PRODUCT OR SERVICE SOLD BY 4XEM SHALL NOT EXCEED THE PRICE OF SAID PRODUCT OR SERVICE. SEVERAL JURISDICTIONS EXIST THAT PROHIBIT THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. THE ABOVE MANY NOT APPLY TO YOU TO THE EXTENT THAT SUCH JURISDICTION’S LAW IS APPLICABLE TO THIS AGREEMENT.

Returns

Return Policy. All merchandise returns must fully comply with the return procedure outlined below. All items returned must arrive in the same condition which they were received, including the original packaging, manuals, cables and accessories. No refunds, credits or exchanges shall be permitted more than 30 days after the date of receipt, or if the UPC code has been removed from the packaging. Unless the item is defective, a restocking fee equal to 25% of the purchase price may be applied on any opened item. This does not apply if the item is exchanged for the same or very similar item. Assessment of the 25% restocking fee will occur at the time of refund or exchange request.

Returns Procedure. To initialize a product return, you must first obtain a Return Merchandise Authorization (RMA) number. To obtain a RMA number, please follow the 4XEM Return of Product Procedure. If you have any questions regarding the return procedure, please contact the 4XEM RMA Department at rma@4xem.com. Commencing on the date the RMA is issued, the particular RMA number is valid for no more than 60 days. All returned items must be sent via pre-paid shipping.
